This agreement ("Terms") governs your use of the With Him mobile application (the "App"), offered by With Him LLC ("we/our/us"). By accessing or using the App, you affirm that you understand, accept, and agree to these Terms.

1. Definitions & Introduction

• "User" or "you": Any individual accessing or using the App.
• "Service": The features offered by the App, including scripture-powered AI conversations ("Talk with Jesus"), daily devotionals ("Daily Encounter"), identity affirmations ("Jesus Mirror"), spiritual check-ins, habit tools, Lifeline Chat, and Sponsorship Functionality.

These Terms form a binding contract between you and us—please read carefully.

2. Acceptance & Modifications

Your continued use of the App signifies acceptance of these Terms. We reserve the right to update them (e.g., for new features or legal changes). Substantial changes will be communicated via in-app notifications or email before taking effect.

3. Eligibility & User Responsibility

• The App is not intended for users under age 13. If you are between 13–17, parental permission is required.
• You agree to use the App responsibly, respectfully, and lawfully—refraining from disrupting services, submitting harmful or harassing content, or engaging in any prohibited behavior outlined herein.

4. Users & Licensing

• License: Subject to your compliance, you are granted a limited, non-exclusive, non-transferable license to use the App.
• Ownership: All content, code, design, and trademarks remain the property of With Him LLC or third-party licensors.

5. Acceptable Use & Prohibited Acts

You must not:

• • interfere with the App's operation or access another user's data
• • input hateful, illegal, or harmful content
• • replicate, reverse-engineer, or redistribute the App's source
• • misuse "Sponsorship" (e.g., for fraud)

6. Spiritual AI: Tone & Limitations

This App offers simulated spiritual conversation guided by Scripture—not pastoral care, professional counseling, or crisis intervention. Responses, while compassionate and scripture-informed, are AI-generated.

7. Privacy & Data

Your use of data is governed by our separate Privacy Policy, linked here withhim.app/privacy and in the app. The Privacy Policy details how we collect, use, and store data—please review it carefully.

8. Sponsorship & Payments

• Paid users may sponsor other seekers.
• All transactions are processed securely via our provider.
• Refunds: Provided at our sole discretion and according to our refund policy.

9. Intellectual Property Protection

All content—including spiritual reflections, UI, code, and Bible-based messaging—is our exclusive IP. You may use in-app content only for your personal spiritual growth; any commercial or unauthorized usage is prohibited.

10. Disclaimers & Liability Limits

• The App is provided "as is," without warranty of any kind.
• We disclaim all liability for damages arising from use—unless limited or prohibited by law.
• Our liability is capped at the total amount you paid for a subscription in the past 12 months, to the extent permitted by law.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of South Carolina, United States of America. Disputes shall be resolved via binding arbitration in South Carolina, except where prohibited.

12. Termination & Account Rights

We may suspend or terminate your access for violations of these Terms. You may also delete your account at any time. Upon termination, your access and rights cease, but we may retain limited data as necessary for legal or financial obligations.

13. Miscellaneous

• Severability: If any part of these Terms is invalid, remaining provisions remain binding.
• No Waiver: Delay or failure to enforce a right doesn't forfeit it.
• Entire Agreement: These Terms and the Privacy Policy constitute the complete agreement regarding your use of the App.

14. Theological-Ethical Standards

The With Him app is designed with reverence, care, and a commitment to spiritual integrity. All AI-generated responses are guided by a theological-ethical framework rooted in the teachings of Jesus Christ, Scripture, and pastoral wisdom.

We work with diverse theological advisors to ensure the app's voice reflects compassionate, Biblically faithful, and non-sectarian Christian principles.

However, no digital product can replace personal prayer, Scripture study, or trusted pastoral guidance. We encourage users to seek those spiritual disciplines alongside their experience in this app.
